Privacy Policy

Last updated: July 8, 2026

Plain-English summary: AI Capone is an entertainment service. We collect your email (to sign you in) and minimal usage data (how many minutes you’ve used, purchase records). Your voice is transcribed in real time by our voice provider in Zero Retention Mode — conversations are not stored and no voiceprint of you is created. We don’t sell your data. You can delete your account and all data at any time from the account menu.

1. Who we are

AI Capone (“AI Capone,” “we,” “us,” or “our”) is operated by HoneyWired LLC. This Privacy Policy explains how we collect, use, and protect information when you use aicapone.net and related services (the “Service”). For privacy questions or requests, contact legal@aicapone.net.

2. Information we collect

Information collected automatically

3. Voice data (and biometrics)

Your spoken audio is processed by ElevenLabs solely to transcribe your words in real time so the assistant can reply, and to generate the assistant’s spoken responses. We operate the assistant in Zero Retention Mode, meaning ElevenLabs does not store or log the audio, transcripts, or personal information from your conversations. We do not record or retain your call audio, and we do not create, collect, or store a voiceprint or other biometric identifier of you. By using the voice feature and granting microphone access, you consent to this real-time processing. You can stop at any time by ending the conversation or denying microphone permission.

4. How we use information

Sponsored messages. Some free minutes are underwritten by sponsors. If you opt in to hear from a sponsor, we send that brand’s message to you ourselves, on their behalf — we do not give the sponsor your email address or any other personal information. Every such message clearly identifies the sponsor, comes from AI Capone, and includes a one-click unsubscribe. You can stop all sponsor messages at any time using that link or by emailing contact@aicapone.net; an unsubscribe applies across every sponsor. A brand would receive your contact details only if you separately and explicitly asked us to share them, or if you signed up directly with that brand.

5. Legal bases (EEA/UK users)

Where GDPR/UK GDPR applies, we rely on: contract (to provide the Service you request), legitimate interests (security, fraud prevention, improving the Service), consent (analytics cookies; voice processing; sponsor marketing opt-ins), and legal obligation (tax/accounting).

6. How we share information (sub-processors)

We do not sell your personal information. We share it only with service providers who process it on our behalf:

ProviderPurpose
ElevenLabsReal-time speech-to-text, voice generation, and conversation orchestration (Zero Retention Mode)
Anthropic (Claude)The AI language model that powers Capone’s responses (via ElevenLabs)
PayPalPayment processing (incl. Venmo where available)
ResendSending sign-in / transactional emails
VercelWebsite hosting and delivery
NeonDatabase (accounts, balances, purchase records)
Google AnalyticsAggregate usage analytics (only with your consent)

Transit lookups (CTA train/bus times) and address geocoding send only the location you ask about — never your personal information — to public transit and mapping data sources. We may also disclose information if required by law or to protect our rights, users, or the public.

Sponsors are not sub-processors. Brands that underwrite free minutes do not receive your email address or other personal information. When you’ve opted in, we send their messages to you through Resend on their behalf, and we remain responsible for that data and for honoring your unsubscribe.

7. International transfers

We operate from the United States, and our providers may process data in the U.S. and elsewhere. Where required, transfers rely on appropriate safeguards such as Standard Contractual Clauses.

8. Data retention

9. Your rights & choices

You can delete your account and all associated data at any time from the account menu (“Delete my account & data”), or by emailing legal@aicapone.net. Depending on where you live (e.g., EEA/UK under GDPR, or California under the CCPA/CPRA), you may also have rights to access, correct, port, restrict, or object to processing, and to withdraw consent. We do not sell or “share” personal information for cross-context behavioral advertising, and we will not discriminate against you for exercising your rights. If you opted in to a sponsor’s messages, you can withdraw that consent at any time via the unsubscribe link in any such email (it stops all sponsor messages) or by emailing contact@aicapone.net. To make a request, email legal@aicapone.net.

10. Security

We use reasonable technical and organizational measures (encryption in transit, httpOnly session cookies, access controls). No system is perfectly secure, so we can’t guarantee absolute security.

11. Children

The Service is intended for adults 18 and older. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us information, contact legal@aicapone.net and we will delete it.

12. Changes

We may update this Policy; we’ll revise the “Last updated” date and, for material changes, provide additional notice. Continued use after changes means you accept the updated Policy.
