1. Agreement to terms
These Terms of Service (“Terms”) are a binding agreement between you and HoneyWired LLC (“AI Capone,” “we,” “us”), governing your use of aicapone.net and related services (the “Service”). By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you don’t agree, don’t use the Service.
2. Eligibility (18+)
You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract. By using the Service you represent that you meet these requirements. Some sponsored offers — for example, those from alcohol brands — require you to be 21 or older; where that applies we indicate it and require your confirmation at sign-up. The Service references bars, nightlife, and alcohol; you are responsible for complying with the legal drinking age and all local laws.
3. What the Service is (and a fictional character)
AI Capone is an entertainment and novelty product: an AI-generated character that suggests Chicago venues, shares local history, and looks up public transit times. “AI Capone” is a fictional, AI-generated character inspired by the historical figure Al Capone (d. 1947). It is not a real person, not a licensed likeness, and is not affiliated with, endorsed by, or representing Al Capone, his estate, descendants, or any third party. Names of venues, brands, teams, and places are used for factual, informational reference only and do not imply any affiliation or endorsement.
AI Capone is a work of expressive entertainment, commentary, satire, and parody concerning a deceased historical public figure. Al Capone died in 1947, and any right of publicity or comparable personal right has long since expired — for example, the Illinois Right of Publicity Act (765 ILCS 1075) provides a 50-year post-mortem term, and Florida, where Capone was domiciled at his death, provides 40 years — so his identity as a historical figure is in the public domain. The character is protected expression under the First Amendment; its use of the Capone persona is transformative and serves purposes of commentary, criticism, education, and entertainment, and is not an endorsement, sponsorship, or licensed likeness of any real person, estate, or descendant.
4. AI output & accuracy — no reliance
Responses are generated by artificial intelligence and may be inaccurate, incomplete, or out of date. Venues may be closed or changed; transit times are estimates from third-party data and may be wrong or delayed. The Service is not professional, travel, legal, financial, or safety advice. Always independently verify anything you plan to rely on. Drink responsibly, never drink and drive, and follow the law and each venue’s own age and entry policies.
5. Accounts
You sign in with a one-time email link. You’re responsible for your email account and for activity under your account. Keep your sign-in link private. Notify us at contact@aicapone.net of any unauthorized use.
6. Minutes, pricing & payment
- The Service is metered in prepaid minutes purchased in packs. Prices and pack sizes are shown at checkout and may change prospectively.
- Payments are processed by PayPal (and Venmo where available). By purchasing, you authorize the applicable charge.
- All purchases are final and non-refundable. Minutes are a digital good delivered immediately; except where a refund is required by applicable law, we do not provide refunds or credits for purchased or unused minutes.
- You are charged only for active conversation time, counted by the second — not for time spent waiting in a queue or while the Service is temporarily unavailable. During heavy traffic we may place you in a short waiting line or briefly limit new sessions to protect quality; your unused minutes remain in your balance. Temporary unavailability, queuing, or delay is not a basis for a refund.
- Minutes have no cash value, are non-transferable, and may expire or be forfeited if your account is closed or deleted.
- We may offer limited free trial minutes at our discretion; these are promotional, non-refundable, and may be changed or withdrawn at any time.
7. Acceptable use
You agree not to: (a) use the Service if under 18; (b) abuse, disrupt, or attempt to overload or circumvent metering, rate limits, or security; (c) reverse-engineer, scrape, or resell the Service or its content; (d) use it for unlawful, harmful, harassing, or infringing purposes; (e) create multiple accounts to abuse free trials; or (f) misrepresent the AI’s output as fact or professional advice. We may suspend or terminate accounts that violate these Terms.
8. Intellectual property
The Service, including its software, design, character, prompts, curated venue data, and audio, is owned by HoneyWired LLC and protected by intellectual-property laws. AI Capone™, the AI Capone logo, and related names, marks, and slogans are trademarks of HoneyWired LLC, and may not be used without our prior written permission. HoneyWired® is a registered trademark of HoneyWired LLC. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial entertainment. All rights not expressly granted are reserved. If you send us feedback, you grant us a royalty-free license to use it. Copyright concerns: dmca@aicapone.net.
Third-party names, marks & fair use. The Service refers to real people, places, businesses, neighborhoods, venues, brands, teams, songs, films, and events for informational, historical, educational, editorial, and commentary purposes. All third-party names, trademarks, service marks, and logos are the property of their respective owners; we claim no ownership of them and use them only nominatively — to identify and refer to the actual person, place, or thing — under the doctrine of nominative fair use and applicable First Amendment protections. Such references do not imply any affiliation with, sponsorship by, or endorsement by those owners. We do not reproduce third-party copyrighted works; factual and historical information is not subject to copyright, and any limited quotation or discussion is fair use for commentary, criticism, and education. If you believe a reference is inaccurate, or that your rights are affected, contact legal@aicapone.net (copyright claims: dmca@aicapone.net).
9. Third-party services
The Service relies on third parties (e.g., ElevenLabs, Anthropic, PayPal, transit data providers). Your use of those features may also be subject to their terms, and we are not responsible for third-party services or content.
10. Disclaimer of warranties
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty regarding accuracy, availability, or uninterrupted operation. You use the Service at your own risk.
We may limit, queue, throttle, suspend, modify, or discontinue the Service (or any part of it) at any time, with or without notice — including during high demand, maintenance, or events beyond our reasonable control — and we do not guarantee that it will be available, uninterrupted, timely, secure, or error-free. We are not liable for any unavailability, delay, queuing, or interruption of the Service.
11. Limitation of liability
To the fullest extent permitted by law, HoneyWired LLC and its owners, members, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of (or inability to use) the Service or reliance on its output. Our total liability for any claim will not exceed the greater of (a) the amount you paid us in the 3 months before the claim, or (b) US $50.
12. Indemnification
You agree to indemnify and hold harmless HoneyWired LLC from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms or the law.
13. Dispute resolution — arbitration & class-action waiver
Please read this carefully — it affects how disputes are resolved.
- Binding arbitration. Any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court.
- Class-action waiver. You and we agree that disputes will be brought only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding. The arbitrator may not consolidate more than one person’s claims.
- Opt-out. You may opt out of this arbitration agreement by emailing legal@aicapone.net within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration.
- This Section survives termination. If any part is unenforceable, the rest remains in effect; if the class-action waiver is found unenforceable, the arbitration agreement is void as to that claim.
14. Governing law
These Terms are governed by the laws of the State of Illinois and applicable U.S. federal law, without regard to conflict-of-laws rules. Subject to Section 13, any permitted court action will be brought exclusively in the state or federal courts located in Cook County, Illinois, and you consent to their jurisdiction.
15. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access at our discretion, including for violations of these Terms. Sections that by nature should survive (IP, disclaimers, liability limits, indemnity, arbitration, governing law) survive termination.
16. Changes to these Terms
We may update these Terms; we’ll revise the “Last updated” date and, for material changes, provide additional notice. Continued use after changes means you accept the updated Terms.
